3. Processing identification - How do we collect personal data?

In compliance with current regulations on the protection of personal data, especially:

Regulation (EU) 2016/679 of the European Parliament and Council, dated April 27, 2016, on the protection of natural persons regarding the processing of personal data and the free circulation of these data (hereinafter, the 'GDPR').

ScopeSmart, a product of Codeshark Pte. Ltd., collects personal data in its possession when the user:

(i) completes the forms on app.scopesmart.xyz ('Site') and accepts the Privacy Policy and Terms of Use before creating an account;
(ii) subscribes to the newsletter;
(iii) answers a poll or completes a web form;
(iv) completes a printed form;
(v) sends an email or communicates by phone, which are then loaded into the corresponding forms.

By accepting the Privacy Policy and Terms of Use during account creation, the user acknowledges and agrees to the processing of their personal data as described in this document.

4. Personal Data Collected - What personal data do we collect?

ScopeSmart, a product of Codeshark Pte. Ltd., collects information when visiting the web page, and primarily through the completion of registration forms on the associated web application.

As a rule, when personal data is requested to use a service or access certain content, its delivery will not be mandatory, except for cases where it is specifically indicated that the data is required for the provision of the service. In such cases, the user must provide the necessary information to proceed with registration and access the service. The user may freely choose not to register and/or not to contract the services if they do not wish to provide the requested data.

The user declares and guarantees that all data provided during the registration process is true and correct and undertakes to keep the information updated. Changes may be communicated to the Data Protection Delegate or to the address indicated in Section 2 of this policy.

Likewise, the user acknowledges that the data required by ScopeSmart is necessary, adequate, and not excessive to fulfill the purposes expressed in Section 5 hereof, and that ScopeSmart may be unable to deliver its services if such data is not provided.

Any false or inaccurate statements provided by the user, as well as any damages that may arise as a result of such information, will be the responsibility of the user.

We retain personal information for 6 months after user accounts remain idle or as long as necessary to fulfill the purposes for which it was collected.

By providing personal data to ScopeSmart, a product of Codeshark Pte. Ltd., the user declares their free, express, and informed consent to ScopeSmart's use of the data collected for the purposes outlined in this Privacy Policy.

ScopeSmart processes user data based on the following legal bases:

8. Validity - How long do we keep it?

ScopeSmart retains personal data only for as long as it is necessary to fulfill the purposes described in Section 5.

Personal data will be kept while the business relationship remains in force. If the user's account remains inactive for a period of 6 months, the personal data associated with that account will be deleted, unless there are legal obligations that require retaining the data for a longer period (e.g., financial records for payment processing or regulatory compliance).

ScopeSmart may retain anonymized data for statistical purposes or for service improvement, as long as such data cannot identify individual users.

9. Confidentiality / Assignment / International Transfer - Do we disclose data to third parties?

ScopeSmart will keep collected personal data private and confidential, and will not use it for purposes other than those set out in Section 5. ScopeSmart requires its employees and third parties providing services that access the contents of the databases to sign confidentiality and personal data processing agreements.

10. Security - How do we ensure data security?

ScopeSmart declares its intention to adopt the necessary technical and organizational measures to ensure the security, integrity, and confidentiality of the data, in accordance with the provisions of the GDPR, UK Data Protection Act (UK DPA), PDPA, and nFDPA. These measures are in place to prevent unauthorized access, tampering, loss, consultation, or unauthorized processing of personal data.

Although ScopeSmart takes all reasonable steps to protect user data, it acknowledges that no system is completely immune to unauthorized access, and users are advised to take measures to protect their own information (e.g., using secure passwords and updating them periodically).

In the event of a security incident that entails a significant risk to the data owner, ScopeSmart will report the incident to the competent authority without delay, alongside any corrective measures implemented.

11. Data owner rights and procedures to respond to their exercise - What rights do I have as a data owner?

The data owner (user) may at any time exercise their rights of access, rectification, deletion, objection, limitation of processing, portability, confidentiality, and erasure of their personal data in accordance with the provisions of the GDPR, UK Data Protection Act (UK DPA), Singapore PDPA, and Switzerland’s nFDPA.
